This study explores the multiple roles of parliaments in enhancing environmental governance and tackling global challenges, while analyzing challenges and proposing ways for development.

Strategic Roles of Parliaments

1. The Legislative Role: Formulating Effective Legal Frameworks
– Developing Integrated Policies: Parliaments possess the authority to enact laws that translate international commitments (such as the Paris Climate Agreements and the Kunming-Montreal Biodiversity Framework) into national frameworks. For example, parliamentarians in India successfully pressured for allocating 1% of the national budget to renewable energy through legislative pressure.
– Bridging Gaps in Agreements: Many international environmental agreements (such as the Convention on Biological Diversity) overlook core issues like deforestation or fossil fuels. Here lies the role of parliaments in enacting complementary legislation, as seen with the National Energy Fund in Uganda, which attracted investments exceeding $150 million.

2. The Oversight Role: Ensuring Accountability and Transparency
– Monitoring Policy Implementation: Using tools such as ministerial interpellations and periodic report reviews, parliaments can uncover shortcomings in law enforcement. In Morocco, for instance, programmed and unannounced environmental inspections are conducted to ensure project compliance with standards.
– Budgetary Oversight: Approving the allocation of financial resources is a crucial tool. In Costa Rica, parliament tied government funding to the achievement of specific environmental indicators, which strengthened forest conservation.

3. The Representation Role: Integrating Marginalized Voices
– Ensuring Fair Participation: Environmental legislation must reflect the needs of groups most affected by environmental degradation (such as indigenous communities and women). Canada’s parliament, for example, integrated the principle of Free, Prior, and Informed Consent (FPIC) for indigenous communities into natural resource laws.
– Protecting Environmental Defenders: United Nations Development Programme (UNDP) reports indicate increasing threats facing environmental activists. Here, parliaments can enact laws ensuring freedom of expression and assembly.

4. The International Coordination Role: Enhancing Cross-Border Integration
– Ratifying Agreements: Parliaments have the authority to ratify international treaties, as happened with European parliaments when adopting the European Climate Law.
– Regional Exchange of Experiences: Networks like the Inter-Parliamentary Union (IPU) facilitate the exchange of successful experiences, such as Kenya’s anti-desertification legislation inspired by Namibian practices.

Challenges Facing Parliamentary Performance
– Short-Term Economic Pressures: Governments often prioritize attracting investments over environmental considerations, undermining legislative efforts.
– Partisan Divisions: In countries like the United States, political polarization prevents the enactment of ambitious climate legislation.
– Weak Oversight Mechanisms: 75% of developing countries lack effective monitoring systems to measure pollution, hindering parliamentary oversight.
– Fragmentation of the Global Environmental System: The multiplicity of agreements (over 500 multilateral environmental agreements) scatters parliamentary efforts.

Mechanisms to Enhance Parliamentary Effectiveness
– Enhancing Accountability via Non-Traditional Mechanisms: Resorting to the judiciary has become a pressure tool, as in the Urgenda v. State case which forced the government to enhance climate adaptation policies.
– Establishing Independent Scientific Bodies: Such as the Global Scientific Advisory Council, which proposes burden-sharing criteria (like carbon budgets) based on fair indicators.
– Adopting a Comprehensive Governance Approach:
* Linking the environment to human rights: The UNDP seeks to establish the right to a healthy environment in 50 countries by 2030, creating legal tools for accountability.
* Institutionalizing participatory approaches: Creating permanent platforms for consultation with civil society before enacting legislation, as in the model of local environmental associations in France.
– Enhancing Financing and Partnerships:
* Private sector incentive packages: In Sweden, parliament linked corporate tax relief to achieving carbon neutrality goals.
* Dedicated environmental funds: Morocco’s Industrial Pollution Control Fund finances clean technology projects.

Conclusion: Towards Effective Parliaments in the Decisive Environmental Decade
Parliaments are not merely legislative bodies; they are vital bridges between global commitments and local implementation. Their success requires:
– Political courage to challenge entrenched interests (such as fossil fuel subsidies).
– Institutional innovation to enhance inclusiveness and accountability.
– Global solidarity to share knowledge and resources.

As Swedish Ambassador Sverker Åström stated in 1972: ‘The principle of national sovereignty is no longer sufficient to face the crises of a planet with an interconnected destiny.’ Parliaments, through their ability to bridge this gap, can be the cornerstone in an era redefining the relationship between humanity and the Earth.

The Role of Parliaments in Environmental Governance and Combating Global Environmental Degradation: Pillars of Effective Governance Amidst the exacerbation of global environmental crises—ranging from climate change and biodiversity loss to cross-border pollution—parliaments emerge as pivotal actors in shaping effective responses.
